Terms and liability waiver
About these terms
These terms apply to ICM Tennis lessons, camps and programs. You accept them on the registration form when you register on our secure JotForm page. The 2020 COVID-19 declaration that was published here before is retired.
Client agreement
On behalf of myself and my child or children, I agree to enter the tennis court only under the supervision of the instructor for the duration of the lesson. I agree not to use the tennis court or any other amenities outside the lesson times offered by ICM Tennis, and not to use other facilities such as basketball courts, pools, volleyball courts, soccer fields, gyms and the track. Breaking these terms may lead to removal from lessons.
Lesson length and schedule changes
Tennis lessons are 60 minutes long, with 55 minutes of instruction. The remaining time is for feedback, equipment cleaning and lesson preparation.
Lesson times may change, and ICM Tennis does not guarantee a permanent time slot. ICM Tennis may cancel classes at its discretion and makes every effort to give notice.
Make-up classes and cancelled classes
Because court time is limited, make-up classes are not offered for missed lessons. As in other activities such as soccer, swimming lessons or hockey, missed class time cannot be made up.
Although we try to avoid cancelling classes, problems with the court or bad weather may require it. In that case, we schedule a make-up session for you. ICM Tennis aims to keep schedules and instructors consistent and will keep parents and students informed of any change.
Payment agreement
There are no refunds or credits once a monthly payment has been processed. I authorize ICM Tennis to charge my account on the 20th of each month for the next month of lessons. I am responsible for providing valid payment information and updating it before tuition is due. If a monthly payment cannot be processed, the reserved space is no longer held.
I may withdraw myself or my child or children from lessons by giving ICM Tennis at least thirty (30) days of written notice by email to info@icmtennis.com. All withdrawals take effect at the end of a month. For example, to withdraw at the end of July, written notice must be received before June 30.
Release of liability
In consideration of taking part in tennis lessons provided by ICM Tennis, I release and forever discharge ICM Tennis and its affiliated companies from all claims, damages and causes of action, known or unknown, arising from participation in the program. I agree to indemnify the released parties against any claim arising from my actions while taking part. The released parties are not responsible for damage to, or the loss or theft of, personal property. I acknowledge the risks inherent in tennis and accept personal responsibility for them. I agree not to start litigation against the released parties based on any claim arising from participation in the lessons.
Medical emergency
I authorize representatives of ICM Tennis to arrange medical treatment in a medical emergency during programs or activities, and I agree to pay the associated costs of medical care and transportation.
Camps: assumption of risk and release
By registering for a camp, I confirm that I am the legal parent or guardian of the participant and that I allow them to take part in tennis and related sports activities, camps, clinics and training sessions organized by ICM Tennis.
Taking part involves inherent risks, including physical exertion, slips, falls, collisions with players or equipment, exposure to weather, dehydration, fatigue and communicable illnesses. I voluntarily assume these risks on behalf of the participant.
To the fullest extent permitted by the laws of Ontario and Canada, I release ICM Tennis, its owners, directors, officers, employees, coaches, assistants, volunteers, contractors, agents, affiliates and facility owners from all claims arising from the participant's involvement in the activities. This release does not apply to gross negligence or intentional misconduct as defined under Ontario law.
Supervision and responsibility
ICM Tennis supervises participants only during scheduled program hours. It is not responsible for supervision before sign-in, after sign-out or outside the program areas, and I accept full responsibility for the participant outside supervised hours.
Weather and refunds
Weather interruptions, air quality issues or facility closures do not guarantee refunds. Make-up sessions may be offered at the discretion of ICM Tennis. Absences for illness, travel, personal scheduling or other reasons unrelated to the program are not refundable.
Your agreement
By accepting these terms on the registration form, I confirm that I have disclosed any medical or health problems in the form, that I understand the release of liability, the waiver of possible claims and the assumption of risk, and that I accept these terms freely and voluntarily. My electronic acceptance is a valid signature under the Ontario Electronic Commerce Act, 2000, and these terms are governed by the laws of Ontario and of Canada.
